Confirmations Basics and Process

This presentation will discuss the confirmation process from a legal and contract administration perspective. The presenters will discuss the use of short form, modified short-form and long-form confirmations; the incorporation of standard terms and conditions by reference; the use of “deemed agreed to” language in a long-form confirm; the signing or non-signing of confirms; battle of the forms (whose confirm governs if both parties send a confirm); and important provisions to include in a long-form. Discussion will also include best practices and key issues to consider in your confirmation process.
