Events over the past couple of years have driven change in the way energy market participants think about force majeure and gone are the days of negotiating “industry standard” clauses. Instead, negotiators are more often tailoring force majeure to the specific parties, projects, or facilities. In this session, Ms. Degard will discuss current thinking regarding force majeure treatment in the energy industry and will provide sample force majeure language to be considered in current negotiations.

Objectives

  • Attendees will participate in a knowledgeable discussion on force majeure treatment with respect to a variety of products, including gas, power, and environmental products, from the perspective of producers or generators, marketers, and buyers and will include example language and issues to consider in your own negotiations.
